I. Statement of Participation

Welcome to the MyCare service for Trinity Health Of New England and certain affiliated health care providers' offices. The purpose of offering you the MyCare service is to provide our patients with Web-based access to relevant portions of their medical records and to allow providers and staff to interact with patients regarding their health care and related information. The following terms and conditions (“MyCare Terms”) govern your use of MyCare. Please read the MyCare Terms carefully, as they impose legal obligations on you and establish your legal relationship with Trinity Health Of New England and/or with your health care provider's office, if that provider is using MyCare. By accepting the MyCare Terms, you acknowledge that you are requesting access to portions of your health information via the Internet using an electronic application called MyCare. If you do not wish to be bound by the MyCare Terms, please do not register for the MyCare Service.

II. Use of MyCare for Healthcare Services

Trinity Health Of New England and certain health care providers offer the MyCare service as a convenience to patients. It is not a substitute for appropriate and timely contact with your physician or other health care provider and should never be used for urgent medical matters.

YOU SHOULD NEVER USE THE MYCARE SERVICE IF YOU HAVE AN EMERGENCY OR THINK THAT YOU NEED TO SPEAK WITH SOMEONE URGENTLY.

IF YOU HAVE AN EMERGENCY, YOU SHOULD CALL 911 OR GO TO THE EMERGENCY DEPARTMENT OF YOUR LOCAL HOSPITAL.

YOU SHOULD NEVER CHANGE OR STOP ANY COURSE OF TREATMENT PRESCRIBED BY YOUR PHYSICIAN WITHOUT FIRST CONSULTING WITH HIM OR HER.

III. Electronic Messaging

You understand that your Trinity Health Of New England team, or your health care provider's team, if they are using MyCare, may send you messages via MyCare. By using MyCare you have agreed to allow Trinity Health Of New England and/or your health care provider to interact with you via messages sent to your MyCare Inbox.These messages may contain information that is important to your health and medical care, including certain laboratory results. It is your responsibility to monitor these messages. If the results are abnormal, or may change your plan of care, then in addition to sending you a message via MyCare, your health care provider will make reasonable attempts to notify you via other methods. You agree to promptly update your email address in MyCare, as needed in order to receive notification of these messages. Trinity Health Of New England, including all of its affiliates or any of its health professionals or other staff, and health professionals or staff of any practice using MyCare (collectively, “Service Provider”) shall not be responsible for notifications that are sent to an email address that you fail to update, or are undeliverable/filtered out due to technical issues with your email provider or ours.

IV. MyCare ID and Password

You will create a unique identification (ID) code and password to be used to access your health information via MyCare. This ID and password are unique codes that identify you in the MyCare computer system. Inquiries and entries that you make via MyCare will be logged with your identity.

It is extremely important that you keep the ID and password that you use to access MyCare completely confidential. If at any time you feel that the confidentiality of your password has been compromised, you should change it immediately by going to the Password link on the MyCare website. You understand that the Service Provider takes no responsibility for and disclaims any and all liability or consequential damages arising from a breach of medical record confidentiality resulting from your sharing or loss of your password. If the Service Provider discovers that you have inappropriately shared your password with another person, or that you have misused or abused your MyCare access privileges in any way, your participation in MyCare may be discontinued by the Service Provider without prior notice.

V. Access by Someone other than the Patient

If you wish to allow someone, such as your spouse, access to your MyCare account, you will be able to grant him or her proxy access from within MyCare. Once you grant Proxy Access to the identified individual, he or she will have full access to your MyCare account, including all of your medical information contained in your MyCare account.

VI. Availability; Accuracy and Integrity of Information

Due to system limitations and applicable laws and regulations, you acknowledge that MyCare accounts may not provide full access to a particular medical record. Generally, patients between the ages of 12 and 17 may not have full access to their medical record through MyCare; however, full access may be obtained by contacting the Health Information Management Department of Trinity Health Of New England or by contacting the medical records office of your individual health care provider's office, depending on which medical record you want.

You acknowledge and understand that MyCare may not be available to you all of the time due to system failures, back-up procedures, maintenance, or other causes beyond the control of the Service Provider. Access is provided on an “as-is, as-available” basis and the Service Provider does not guarantee that you will be able to access MyCare at any particular time.

Trinity Health Of New England and its affiliates have no control over a physician’s or laboratory’s medical record entries, progress notes, or diagnostic or treatment recording, and does not monitor physician or other provider communications or entries of any kind via the MyCare service. Therefore, it cannot guarantee the accuracy or medical appropriateness of such entries. The MyCare service is not a substitute for telephonic or in-person communication with your health care providers and MyCare services should not be relied upon for medical decision making or as an alternative to office visits. If you ever have any questions about the accuracy or meaning of the information in your MyCare record; please contact your health care provider’s office.

YOU UNDERSTAND THAT THE SERVICE PROVIDER TAKES NO RESPONSIBILITY FOR AND DISCLAIMS ANY AND ALL LIABILITY ARISING FROM ANY INACCURACIES OR DEFECTS IN SOFTWARE, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORK, THE INTERNET OR INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE THAT YOU USE TO ACCESS MyCare.

VII. Confidentiality and Security

Trinity Health Of New England complies with applicable HIPAA privacy and security standards with respect to your medical information at Trinity Health Of New England. Your health care provider's practice is responsible for compliance with applicable HIPAA privacy and security standards with respect to your medical information at your health care provider's practice. You are solely responsible for the disclosure of your MyCare content that you intentionally or unintentionally communicate to others.

VIII. Termination of Access

The Service Provider may restrict or terminate your access to MyCare at any time without notice upon your violation of the MyCare Terms, as determined by the Service Provider in its sole discretion.

IX. Governing Law

The MyCare Terms shall be governed in all respects by the laws of the State of Connecticut without giving effect to its conflicts of law provisions. You agree to submit exclusively to the personal jurisdiction of and venue in the state and federal courts of the State of Connecticut, in the judicial district of Hartford.
